Are CBD Pre-Rolls Legal?

Because our CBD pre-rolls look like the joints you’d typically associate with cannabis, we’re often asked if they’re legal. In short, yes, our CBD pre-rolls are legal throughout the United States. 

Our CBD pre-rolls are 100 percent pure CBD hemp flowers. They can be smoked the way you’d typically smoke a cigarette or joint -- but they’re legal throughout the United States.

CBD vs THC

Before we explore why CBD pre-rolls are legal, let’s define the difference between CBD and THC.  

Cannabidiol, or CBD, is one of the many chemicals that are naturally found in cannabis and hemp plants. These chemicals are called “cannabinoids.” Another well-known cannabinoid is tetrahydrocannabinol (THC). 

While CBD and THC have many differences, one of the key differences is that THC is intoxicating while CBD is not. 

Hemp vs cannabis: what’s the difference?

Most people use the word “cannabis” to refer to the plant that makes you feel intoxicated, also called weed or marijuana. 

Hemp and cannabis are technically the same species of plant. The main difference is that hemp can’t get you high, while cannabis can. 

The law defines cannabis as having more than 0.3 percent THC. Since THC is intoxicating, cannabis can make you feel intoxicated. Because hemp legally must contain 0.3 percent THC or less, it can’t make you feel intoxicated.

CBD is present in both hemp and cannabis, and you can technically derive CBD from hemp or cannabis. Our high-quality CBD, however, is always derived from US-grown hemp. 

Hemp isn’t just grown for the purposes of making CBD. Hemp crops can also be used to make: 

  • Food (such as hemp seed and hemp oil)
  • Paper
  • Fabric
  • Animal feed
  • Plastic

Because hemp grows fast, it’s a sustainable resource. All parts of a hemp plant can be used to produce items, which makes it an environmentally-friendly crop. 

What the law says about hemp

Up until recently, it was technically illegal to grow hemp, although this law was seldom enforced. The 2018 Farm Bill made it legal to grow hemp throughout the United States. It also made it legal to manufacture and use hemp-derived CBD products like ours. 

Because of this, it’s legal to enjoy a hemp-based pre-roll

It’s worth remembering that cannabis is not entirely legal throughout the country. Medical cannabis is in some states, and in other states it’s legal for both medical and recreational use, but it’s not yet legal at a federal level. 

What do people use CBD pre-rolls for?
